Publishing Policies
LifeVest Publishing, Inc. provides publishing services to authors who want to formally publish their work. LifeVest Publishing Inc. reserves the right to refuse publication of any manuscript, illustration, photo, artwork, or any material that promotes hate, violence or any offensive behavior and/or action against others. LifeVest Publishing, Inc. will NOT publish, print, or promote illicit, illegal, or pornographic material of any kind. LifeVest Publishing, Inc. reserves the right to deny publishing printing, or marketing of any material that it deems obscene and/or offensive in nature by Lifevest Publishing, Inc. management or editing staff.
Right-To-Use Policy and Indemnities
Copyrights, trademarks, patents, right-to-use authority, and permissions are owned and maintained solely by the Author of the publication. All rights of ownership, authorizations of use, and permissions are the sole-responsibility of the publishing Author. The Author represents and warrants that he or she is the sole author of the publication; that he or she has not engaged in plagiarism; that the publication is accurate in all respects (if fiction, it represents no real event or person in a way that could be deemed libelous; if non-fiction, it does not misstate any material fact or omit any material fact, the result of which could libel any person or result in a person being placed in a false or damaging light); that he or she is owner of any trademarks and/or trade names associated with the publication; and that the author has the right to enter into this Publishing Agreement.
The Author agrees to indemnify Lifevest Publishing, Inc. and its employees from any manner of claims, liabilities, damages, expenses, awards, and judgements resulting from claims of third parties regarding ownership, libel, slander, plagiarism, privacy, and similar claims arising from publication of the contracted title.
Mandatory Disclaimer
Regardless of the written materials, the author is solely-responsible for the content and rights to the content of their work. Any permissions or approvals required for publishing, printing, or copying due to Copyrights, Patents, Trademarks, etc. held by other parties, are the sole responsibility of the author.
Author's Rights
The Author owns and maintains all rights to their publication. LifeVest Publishing, Inc. claims no rights to the Author's works, Copyrights, Patents, or Trademarks. The Author maintains all rights to notes, manuscripts, photos, artwork, illustrations, and printed copies of the publication. The Author has the right at anytime to change publishers, printers, or use marketing services provided by other businesses and agencies without notice. LifeVest Publishing, Inc. claims no rights to any portion of any Author's publication unless specifically written by, and published for, employees of LifeVest Publishing, Inc., for Lifevest Publishing, Inc. Lifevest Publishing, Inc. maintains the right to store a digital copy of the Author's publication for ease of correcting, changing, updating, and printing only. The digitally stored copy is protected by the Author's Rights and will not be shared, sold, or given to any other party or business as part of this agreement with the Author.
Exclusivity and Term
This Agreement is non-exclusive. LifeVest Publishing, Inc. retains all digital property and ownership related to all completed production data and files. Either party, LifeVest Publishing, Inc., or the Author, has the right to terminate this Publishing Agreement at anytime, with or without cause. If the Publishing Agreement is terminated by the Author, the publishing fees will not be refunded. If the Publishing Agreement is terminated by LifeVest Publishing, Inc., the publishing fees will be refunded in full. Publishing fees do not encompass pre or post publication services such as typing, editing, promotional materials, book sales, or the additional fees as listed on page 2 of this agreement.
The Term of this Publishing Agreement is two (2) years from the date of publication. LifeVest Publishing, Inc. reserves the right to offer renewal of the Publishing Agreement at that time. If the Author does not submit the complete materials for publishing within one (1) year from the date of this Publishing Agreement, no fees are refundable.
